Welcome to Bum Seating (Pty) Ltd. These Terms & Conditions govern your use of our website and the purchase of products from www.bumseating.co.za. By accessing or using our website, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please refrain from using our website.

Use of Our Website

You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the website.

Use the website for fraudulent or unlawful activities.
Attempt to gain unauthorised access to our systems.
Upload or distribute viruses or malicious software.
Interfere with the operation or security of the website.

Product Information

We make every reasonable effort to ensure that product descriptions, specifications, images and pricing displayed on our website are accurate and up to date.

Pricing

All prices displayed on our website are in South African Rand (ZAR) and include VAT unless otherwise stated.

Although we strive to ensure that all pricing is accurate, pricing errors may occasionally occur. If an incorrect price has been published, we reserve the right to cancel the affected order and issue a full refund where payment has already been received, subject to applicable South African law.

Prices are subject to change without notice. Any price change will not affect an order that has already been validly confirmed and accepted by Bum Seating, except where otherwise permitted or required by law.

Orders

Submitting an order through our website does not constitute acceptance of that order.

Orders are only accepted once payment has been received and the order has been confirmed by Bum Seating.

We reserve the right to refuse or cancel any order where:

Products are unavailable.
Incorrect pricing has been displayed.
Fraud or suspicious activity is reasonably suspected.
Payment cannot be verified or successfully processed.
There has been a system, technical or administrative error.

If Bum Seating cancels an order after payment has been received, a full refund will be processed, subject to applicable law.

Order Confirmation, Approval and Cancellation

Once an order has been confirmed and accepted by both Bum Seating (Pty) Ltd (“Bum Seating”) and the customer, and payment has been received, the order shall be regarded as final, confirmed and binding on both parties.

Where a sample, specification, drawing, image, product selection or other representation has been provided to the customer for approval, the customer's approval or acceptance thereof shall constitute confirmation that the customer has reviewed and accepted the relevant product, specifications, design, colour, dimensions and/or other applicable details of the order.

Following confirmation of the order and, where applicable, approval of the sample or specification, the customer may not cancel, amend, return or withdraw from the order, and no refund, reimbursement or credit shall be due in respect thereof, except where such cancellation, amendment, return, refund or reimbursement is required or permitted by applicable South African law.

Bum Seating reserves the right to recover any reasonable costs, losses, expenses or liabilities incurred as a result of a customer's cancellation, amendment or refusal to accept an order after it has become final and binding, to the extent permitted by applicable law.

Nothing in this clause is intended to limit, exclude or waive any right or remedy afforded to the customer under any applicable legislation, including the Consumer Protection Act 68 of 2008, where such right or remedy cannot lawfully be excluded or limited.

Payment

Payment must be received in full before goods are dispatched unless alternative payment arrangements have been agreed to in writing by Bum Seating.

All online payments are processed through secure third-party payment providers.

Delivery

We deliver throughout South Africa using trusted courier partners.

Delivery timeframes are estimates only and may vary due to:

Stock availability
Courier delays
Public holidays
Weather conditions
Remote delivery locations
Events or circumstances beyond our reasonable control

Risk in the goods passes to the customer upon successful delivery, to the extent permitted by applicable law.

Customers are responsible for ensuring that delivery details supplied to Bum Seating are accurate and complete.

Inspection of Goods

Please inspect your order upon delivery.

If your order has been damaged during transit, is incomplete, or you have received an incorrect item, you should notify us within 48 hours of delivery so that we can investigate and resolve the matter promptly.

This notification period does not limit or exclude any statutory rights or remedies available to consumers under applicable South African law.

Warranty

Selected products are covered by our 5-Year Manufacturing Warranty against defects in materials and workmanship.

The warranty does not cover:

Normal wear and tear
Misuse or abuse
Incorrect assembly
Accidental damage
Commercial misuse outside the product's intended purpose
Unauthorised repairs or modifications

Proof of purchase is required for all warranty claims.

Returns & Refunds

Returns and refunds are handled in accordance with our Warranty, Returns & Refund Policy and applicable South African consumer legislation, including the Consumer Protection Act.

Where applicable:

Returned products should be in their original condition.
Proof of purchase may be required.
Certain products may not be eligible for return due to hygiene, customisation or other lawful exclusions.

Nothing in these Terms & Conditions is intended to remove or restrict any consumer right that cannot legally be excluded.
